Why Do I Need To Make A Will?

Did you know that two thirds of people in the UK die without leaving a will? This creates much stress, heartache, and often despair for loved ones left behind.

A will is a legal document that allows you to state what will happen to your possessions, money, and property when you pass away.

These combined 'assets' are called your 'estate'.

If you pass away without making a will, the government will follow what are called the 'rules of intestacy, guidelines that decide how your assets will be distributed.

These rules are over 100 years old, and do not take into account many aspects of a modern lifestyle, such as step-children, unmarried couples, or your personal preferences on who gets your assets.

So, it is advisable that everyone makes a will, however large or small their estate is. By doing so, YOU decide who will receive your property, any monies, or other assets, and/or how they will be divided up.

If you have children under 18, your will can also be used to choose a legal guardian. Without a will defining this, children could end up with social services and the courts making decisions on who looks after them.

Your questions answered?

Are your wills legal in the United Kingdom?

A will from OnlineWill.co.uk is fully legal in England & Wales. Scotland has slightly different rules. You should seek further legal advice if you are a resident of Scotland.

Many people are concerned about whether their will will stand up to legal scrutiny when they pass away. However, as long as a will is worded correctly, signed and witnessed, it is a fully legal document. IT does not need a legal professional to write or sign it.

Once completed and printed out, your will can be witness by almost any two adults provided they are not listed as beneficiaries, and are not the spouses of beneficiaries.

They will need to physically see you sign the document, and they can then sign as witnesses. Upon their signing, your will is legal and can be used upon your death.

Can I update my will?

Yes. After completing your will questionnaire and making payment, you will be sent login details via email. You can login to the portal and update your will as many times as you choose within a 14 day period.

How do I get my will once I have paid?

After going through the checkout you will be redirected to a final page where you can download your completed will as a PDF document. You will also receive an email with a copy of your will, and login details to enter the portal to make amendments.

What do I need to do next?

To ensure the legal standing of the will, you will need to get 2 witnesses who can observe you signing your will, and who will then sign and date the document as witnesses.

Do I need a solicitor?

Typically, a solicitor is not required to make a will that is legal in England and Wales. Provided the will is produced using the correct wording and format, it is just as legal as if a solicitor had created it.

If your personal circumstances are extremely complicated a legal professional is probably a good idea. But for a basic will that meets the needs of the majority of people, our service is perfect.

And remember, you pay nothing until you have checked the will form and completed it. So there is no risk to you.
